  1. Collection, Processing and Storage of Personal Data when Visiting our Website

In the following, we will inform you about the processes relevant to data protection that take place when you call up our website.

2.1 Log Files

Each time you visit our website, we automatically collect data and information from the computer system that you use to access the website.

The following data is collected:

(1) Information about your browser type and the browser version you are using
(2) Information about your operating system
(3) Date and time of your access
(4) Websites from which your system accesses our website
(5) Websites that are accessed by your system via our website

The data is stored in the log files of our system. Not affected by this are your IP addresses or other data that allow the data to be assigned to you. This data is not stored together with other personal data of yours. The legal basis for the temporary storage of this data is Art. 6 para. 1 lit. f GDPR. The log files are automatically deleted after seven days.

The collection of data to provide our website and the storage of data in log files is mandatory for the operation of our website. Therefore, there is no possibility for you to object.

3.1 Google Maps

On our website we integrate the service “Google Maps”. Google Maps is operated by Google Cloud EMEA Ltd,.

Google Maps is used to visually display geographic information in interactive maps. When using Google Maps, Google also collects, processes and uses data about the use of the Maps functions by visitors to the websites.

The processing of the data is based on our legitimate interest, i.e. the optimization of our offer and our website according to Art. 6 para. 1 lit. f. GDPR.

3.2 Vimeo

We integrate the service “Vimeo” on our website, which is provided by Vimeo Inc., 555 West 18th Street, New York, New York 10011, United States.

On some of our pages, we use plugins provided by Vimeo. If you access the pages of our online offering that integrate such a plugin, a connection to the Vimeo servers is established and the plugin is displayed.

This tells the Vimeo server which of our pages you have visited. If you are logged in as a Vimeo member, Vimeo connects this information to your personal user account. When using the plugin, for example by clicking the start button of a video, this information is also connected to your user account. You can prevent this assignment by logging out of your Vimeo user account before using our website and deleting the corresponding cookies from Vimeo.

  1. Will Your Data be Transferred? 

4.1 Transferring Data to Service Provider 

To the extent that we involve service providers who support us in the processing of personal data or otherwise (for example, web designers, hosting or other IT service providers) and who may come into contact with your personal data in the process, this will only happen after the prior conclusion of a so-called Data Processing Agreement pursuant to Art. 28 (2) GDPR, with which we oblige our service providers to process personal data only in accordance with our instructions and to treat you confidentially. Processors will only have access to personal data that is necessary for us to perform your services.

4.2 Transferring Data to Third Parties

In other cases, we will only disclose your personal data if this is permitted by relevant legal provisions, for example, if we are obliged to do so by law or by an official or court order (Art. 6 (1) sentence 1 lit. c GDPR) or if you have consented to the disclosure (Art. 6 (1) sentence 1 lit. a GDPR).

4.3 Will your Data be Transferred to Third Countries? 

If your personal data is transferred to a third country, we have taken appropriate measures to ensure that the level of protection for natural persons guaranteed by the GDPR is not undermined. In particular, we have concluded standard contractual clauses with processors that process personal data in a third country.

5. Online Presences in Social Networks (External Media)

5.1 Purposes and Risks

We are present in various social networks to offer you information about us there, to present our company and to communicate with active users.
We do not process any personal data via the social network image logos embedded on our homepage. Only the active clicking of the image logos activates the direct forwarding to our online presence in the corresponding social network linked in the background. The respective network processes personal data during your visit. For your information, we have linked the respective privacy notices of the networks we use below.

We would like to point out that the data of social network users is usually processed by these networks for market research and advertising purposes. User profiles can be created on the basis of user behavior. These can be used, for example, to display advertisements outside the network. Furthermore, we point out that when using social networks, data may be processed outside the European Union. As a result, risks may arise for you, such as more difficult legal enforcement.

5.2 Types of Data Processed 

Contact data (e.g., email, telephone numbers), inventory data (e.g., names, addresses, age), content data (e.g., text entries, photographs, videos), usage data (e.g., web pages visited, interest in content, access times) and Communication data (e.g. device information, IP addresses) are processed when you visit us on the social networks.

If social networks provide us with statistical information about the visitors to our profiles/fan pages, this is done in aggregated (summarized, anonymized) form, conclusions about individual users and access to individual user profiles by us is not possible.

5.3 Subjects 

Data is collected from website visitors and registered users of social networks.

5.4 Legal Basis 

We consider it necessary for the fulfillment of our tasks to present Molle&Korn in social media in order to inform about our work and to communicate with users in this way (Art. 6 para. 1 p. 1 lit. e. GDPR in conjunction with. § 3 BDSG (German Federal Data Protection Act)).

Joint Accountability with LinkedIn

We use the statistical information (the visits to our website, the volume of interactions, information about which countries and cities our visitors come from, and statistics about the area of work of our visitors) in connection with the use of our LinkedIn company page, which LinkedIn provides in anonymized form via the LinkedIn “Analytics” service. Conclusions about individual users and access to individual user profiles by us are not possible.

For this reason, we are considered “joint controllers” with LinkedIn according to Art. 26 GDPR and have therefore concluded a so-called joint responsibility agreement. Beyond the processing of personal data mentioned in this privacy policy, we have no influence on the processing of personal data in connection with your use of our LinkedIn company page.

LinkedIn has assumed primary responsibility for the processing of personal data via the “Page Insights” service offered by LinkedIn. This concerns the processing of “Page Insights” data and the enforcement of data subjects’ rights. Please contact LinkedIn directly regarding any obligations related to the processing of “Page Insights” data. Although you can exercise your rights against us, we will forward your requests we receive to LinkedIn.

7. What Rights Do You Have with Regard to Your Data? 

You have the right:

  • to revoke your consent pursuant to Art. 7 (3) GDPR with effect for the future. The lawfulness of the processing carried out on the basis of the consent until revocation remains unaffected.
  • to request information about your personal data processed by us in accordance with Art. 15 GDPR. In particular, you can request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right of access to your personal data, and the nature of your data to correction, deletion, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it was not collected by us, as well as about the existence of an automated decision-making, including profiling, and, if applicable, meaningful information about its details. The restrictions according to § 34 FDPA apply;
  • in accordance with Art. 16 GDPR, you have the right to request the correction of incorrect or incomplete personal data stored by us without delay;
  • in accordance with Art. 17 GDPR to request the deletion of your personal data stored by us, unless the processing is for the purpose of exercising the right to freedom of expression and information, to comply with a legal obligation, for reasons of public interest, or to assert, exercise or defend legal claims. The restrictions according to § 35 FDPA apply;
  • to request the restriction of the processing of your personal data in accordance with Art. 18 GDPR, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure, and we no longer need the data, but you need it for the assertion, exercise or defense of legal claims, or you have objected to the processing in accordance with Art. 21 GDPR;
  • pursuant to Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, common and machine-readable format, or to request; it be transferred to another controller, and
  • pursuant to Art. 77 GDPR to complain to a supervisory authority. We will then no longer process the personal data unless there are compelling legitimate grounds for the processing which override your interests, rights and freedoms as a data subject, or the processing serves to assert, exercise or defend legal claims.

8. Existence of Automated Decision-Making Including Profiling 

For the establishment and implementation of the business relationship, we generally do not use automated decision-making pursuant to Art. 22 GDPR. If we use these procedures in individual cases, we will inform you separately, provided this is required by law. We do not process your data with the aim of automatically evaluating certain personal aspects.
